These Terms and Conditions (the “Terms”) govern your access to and use of www.ashburysecure.co.uk and any related services and physical products operated by Paola Iraca, trading as Ashbury Secure Solutions (sole proprietor, SIREN 101 164 473, SIRET 101 164 473 00015, APE 62.01Z), 29 Boulevard d’Alsace, 06400 Cannes, France (“Ashbury Secure Solutions”, “we”, “us” or “our”). By browsing, registering for an account, or placing an order on the site, you agree to be bound by these Terms together with our Privacy Policy, Cookies Policy, Refund Policy, Shipping and Delivery Policy and Cancellation Policy, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not use the site.

1. Who we are and how to reach us

Ashbury Secure Solutions is the trading name of Paola Iraca, trading as Ashbury Secure Solutions (sole proprietor, SIREN 101 164 473, SIRET 101 164 473 00015, APE 62.01Z), 29 Boulevard d’Alsace, 06400 Cannes, France. 2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to buy from the site. By placing an order you confirm that you have legal capacity to enter into a binding contract and that the personal information you provide is accurate and complete.


3. Products and services

We sell Modern Security & Privacy Essentials, physical products designed to help protect your home, devices, travel, and personal data. Our range includes items such as smart home security devices, privacy screens, signal-blocking pouches, secure travel accessories, personal safety tools, and related security hardware. Each product page describes what is included, the specifications, and any compatibility requirements.

Product images and photos are representative. Colours and small details may vary slightly from the images shown. We reserve the right to update, improve or discontinue any product at any time without notice. Where a product is discontinued, we will fulfil any outstanding orders already placed before the discontinuation date.


4. Orders, prices and payment

When you place an order through the checkout, you make an offer to buy the products selected at the prices and on the terms set out at that moment. The contract of sale is formed when we send you an order confirmation email. We may decline an order if a product is no longer available, if the price was displayed incorrectly due to a clear error, or if we suspect fraud or breach of these Terms.

All prices are shown in the currency selected by you at checkout. The currency, line items, applicable taxes and the total amount are displayed before you confirm payment. Where the law of your country of residence requires VAT or another consumption tax, that tax is included in the price unless otherwise stated.

We accept payment by Visa, Mastercard and other card schemes supported by our payment provider myPOS Payments, an authorised electronic money institution. Card payments are processed directly by myPOS through a 3D Secure flow. Strong Customer Authentication may be required by your card issuer. We never receive, store or process your full card number, CVV or PIN.


5. Shipping and delivery of physical products

Delivery timescales, shipping methods, carriers, costs, and the procedure for handling lost or damaged items in transit are set out in our Shipping and Delivery Policy. We aim to dispatch orders promptly; however, delivery timescales are estimates and not guaranteed. Risk of loss and title to the products pass to you upon delivery to the address specified in your order. If your order does not arrive within the expected timeframe, please contact us at support@ashburysecure.co.uk so we can investigate.


6. Refunds, returns and cancellations

You have the right to return physical products in accordance with our Refund Policy and applicable consumer protection law. Products must be returned in their original, unused, and undamaged condition with all original packaging. Refund rights, eligibility criteria, return shipping responsibilities, and processing timelines are set out in our Refund Policy. Cancellation rights are set out in our Cancellation Policy. Refunds are issued only to the original payment method, in line with the rules of myPOS Payments and the card schemes.


7. Acceptable use

You may use the site only for lawful purposes. You agree not to:

  • use the site for any unlawful, harmful, fraudulent, infringing or offensive activity;
  • attempt to bypass, disable or interfere with the security features of the site;
  • use automated tools to scrape or copy the site beyond what robots.txt permits;
  • purchase products for the purpose of reselling, redistributing, or reverse engineering them in a manner that infringes applicable law or our intellectual property rights;
  • provide false or misleading information when placing an order or creating an account.

We may suspend or terminate your access to the site at any time, with or without notice, if we reasonably believe you have breached these Terms.


8. Intellectual property

All trademarks, logos, page designs, written content, photography and other materials on the site belong to Ashbury Secure Solutions, to Paola Iraca personally, or to our licensors. Nothing on the site grants any licence to use those trademarks or materials without our prior written consent. The physical products we sell may be subject to the intellectual property rights of their respective manufacturers.


9. Third party services

The site uses third party services to operate, including WordPress and WooCommerce as the platform, myPOS Payments as the payment provider, and analytics tools listed in our Cookies Policy. We are not responsible for the acts or omissions of these third parties beyond what their respective terms and our data processing agreements with them require.


10. Customer accounts

You may need to create an account to access order history and manage your purchases. You are responsible for the security of your account credentials and for any activity that occurs under your account. Notify us at support@ashburysecure.co.uk as soon as you suspect any unauthorised access. You can delete your account at any time from the customer area or by writing to us, subject to record keeping obligations described in our Privacy Policy.


11. Limitation of liability

To the maximum extent permitted by law, our liability to you arising out of or in connection with the site or any product is limited to the price paid by you for the product that gave rise to the claim. We are not liable for indirect or consequential losses, loss of profits, loss of business, or loss of data. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.

You retain your statutory rights as a consumer under French law and applicable European Union law. Those rights are not affected by these Terms.


12. Force majeure

We are not liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from an event beyond our reasonable control, including but not limited to natural disasters, war, sabotage, government action, supplier or logistics failures, or pandemic. We will use reasonable efforts to mitigate the impact and to resume normal service as soon as practicable.


13. Changes to the Terms

We may update these Terms from time to time. The current version is always available on this page with the last updated date shown at the top. Where a change is material, we will give you reasonable advance notice by email or by a banner on the site. Continued use of the site after the effective date constitutes acceptance.


14. Governing law and dispute resolution

These Terms are governed by French law. Any dispute arising out of or in connection with these Terms or any transaction made through the site is subject to the exclusive jurisdiction of the courts of Nice, France, except where mandatory rules of consumer protection grant you the right to bring proceedings in the courts of your country of residence.

If you are a consumer residing in the European Union and a dispute arises which we cannot resolve directly, you may use the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. You can also contact the French consumer mediator listed on our Contact page.


15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force.


16. Entire agreement

These Terms, together with the Privacy Policy, Cookies Policy, Refund Policy, Shipping and Delivery Policy and Cancellation Policy, constitute the entire agreement between you and Ashbury Secure Solutions concerning the site and supersede any prior agreement on the same subject.
